COMMISSIONER FOR PROTECTION OF EQUALITY - THE ROLE, JURISDICTION AND MODE OF OPERATION IN CASES OF DISCRIMINATION

Summary

The organisational and functional aspect of work of the Commissioner for Protection of Equality, an autonomous and independent body, specialised in the fight against discrimination, is reviewed in the paper. The guarantees of the institution s independence and jurisdictions are in the focus. The procedure following the complaints against discrimination is analysed thoroughly, as well as the mode of its initiation, the circle of actively legitimised subjects, the flow of the procedure, the mode of establishing a factual state, and the potential outcome of this procedure. Adequate attention is paid to the instruments of civil law protection and criminal law protection against discrimination, as well as the manner of realisation of the statutory authorisation of the Commissioner in the areas of discrimination prevention and realisation and advancement of equality.
