DISCIPLINARY ACCOUNTABILITY OF POLICE SERVANTS
Summary
This article is a synthesis of some theoretical and practical issues related to disciplinary accountability of police servants in the Ministry of Interior; to procedures of disciplinary actions; and to rendering the first and second instance decisions in disciplinary proceedings. The article also presents a critical insight in the novelties related to disciplinary accountability introduced in the Law on Alterations and Amendments of the Law on Police, as well as an expert overview on the Administrative Court Case Law.
Bearing in mind the sensitive and important role of the police service in society, it is of utmost importance that the rules and procedures for establishing disciplinary accountability are well defined and implemented. The way to achieve a satisfactory level of quality in disciplinary proceedings is fo assure permanent self-education of individuals, adherence to values and rules established in the Code of Police Ethics, adequate organisation and understanding of one’s own role in achieving the Ministry of Interior's mission in a democratic society in line with the highest national and international standards of police conduct.
The author is an attorney at law from Belgrade, formerly presiding the Disciplinary Commission of the Ministry of Interior, as the second instance body, and the Council of the Disciplinary Commission, as the first instance body.
